The security of your personal data is our priority. We therefore pay due attention to personal data and their protection and process them in full compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as the “GDPR Regulation”), and in accordance with these Policies. In these Policies, we would therefore like to inform you what personal data we collect about you and how we further use them.
WHO PROCESSES YOUR DATA:
Your personal data under the conditions set out below will be processed by Education Initiative, s.r.o., with its registered office at Kukučinova 4, 902 01 Pezinok, Company ID: 47 122 684, VAT ID: SK2023761234, registered in the Commercial Register of the District Court Bratislava 1, Insert No.: 88852/B (hereinafter referred to as “we” or “jollyphonics.sk”), the operator of the online store on the jollyphonics.sk website, in the position of controller. jollyphonics.sk currently does not have an appointed Data Protection Officer. WHAT PERSONAL DATA WE COLLECT:
jollyphonics.sk may store and otherwise process your personal data which you provide to us in connection with the use of our services, mainly when concluding a purchase agreement with us through the jollyphonics.sk website or by subscribing to our newsletters.
These mainly include the following personal data:
– first name, surname, date of birth, e-mail address, telephone number, residential address, delivery address, bank account number or payment card number, other data voluntarily provided by you when registering or creating an order, and data concerning the goods viewed or purchased by you
In connection with your activity on our website, we also collect and process your IP address and cookies. The processing and use of cookies are governed by separate policies, which you can find here.
All personal data we process come directly from you.
FOR WHAT PURPOSES WE PROCESS PERSONAL DATA:
We may process your personal data for one or more of the following purposes:
– Administration and processing of your purchase through the e-shop. We use your personal data so that we can deliver the goods you ordered, inform you about the status of your order, or handle your exercised right to withdraw from a concluded purchase agreement or your complaint regarding goods.
– Administration and processing for the purpose of creating a personal profile on our website
– Sending various commercial offers and newsletters so that we can inform you about the latest discounts, latest news, new goods, promotional campaigns and other related information
– Responding to your inquiry sent via contact details or on the basis of contacting customer support
– Improving the quality of our services and developing new ones
– Analysis of your preferences and display of content corresponding to your individual needs
– Recovery of receivables and enforcement of our rights (e.g. in the event of court disputes relating to our services), and
– Keeping accounting records and fulfilling our other legal obligations.
WHAT ENTITLES US TO PROCESS DATA?
jollyphonics.sk is entitled to process your personal data on the basis of at least one of the authorizations listed below:
– Performance of a contract. The most common legal basis for collecting and processing your personal data is the conclusion of a purchase agreement through the e-shop. For this purpose, you have provided us with your personal data because without them the contract cannot be validly concluded and the purchase cannot be completed. In this case, the establishment of your personal profile on the jollyphonics.sk website is also considered a contract, where acceptance of the conditions leads to the conclusion of the contract. Without providing your personal data, it is therefore not possible to create your personal profile.
– Compliance with legal obligations. In particular, with regard to the processing of invoices and their administration, your personal data are processed for the purpose of fulfilling legal obligations related to tax and other legal regulations.
– Consent. In some cases, we also process your personal data on the basis of your freely given prior consent. This mainly concerns consent to the sending of newsletters and related marketing purposes. Your consent may be withdrawn by you at any time in accordance with the procedure set out in these Policies. Failure to provide or withdrawal of consent does not affect the processing of your personal data on the basis of another authorization.
– Legitimate interests of jollyphonics.sk. We are also entitled to process your personal data for the purposes of our legitimate interests. This mainly concerns direct marketing or ensuring the security of our website.
TO WHOM WE MAY PROVIDE PERSONAL DATA:
Within the scope of the above authorization, we may also sell/provide your personal data to the following entities:
– Carriers responsible for delivering the goods ordered by you
– Our business partners, especially google.com
– Payment gateway providers (payment card providers)
– Our tax and legal advisors in connection with the enforcement of our rights
Under certain conditions prescribed by law, we are also obliged to provide or disclose your personal data, for example to law enforcement authorities (especially the Police of the Slovak Republic) and other public administration bodies.
HOW LONG WE RETAIN YOUR PERSONAL DATA:
jollyphonics.sk processes and stores your personal data only for the period necessary for the purposes stated above. In the case of processing personal data on the basis of your consent, for the period for which the consent was granted (usually 5 years), unless such consent is withdrawn by you earlier. After the expiry of this period, jollyphonics.sk retains your personal data (especially consent and withdrawal of consent) to the extent necessary for the possible defence of its rights.
In the case of processing personal data, jollyphonics.sk processes and stores your personal data at least for the duration of the concluded contract and until the expiry of statutory or contractual limitation periods and periods for exercising rights arising from defective performance or warranty for the possible exercise, determination or defence of our claims.
At the same time, we would like to inform you that your personal data are also retained in cases where this is required by legal regulations, and only for the period prescribed by such legal regulations (in particular archiving periods for accounting and tax documents).
HOW YOUR PERSONAL DATA ARE PROTECTED:
All personal data you provide to us and that we process are secured using standard procedures and technologies. All security measures are regularly checked, especially whether there are any weak points in the system and whether it has not been exposed to attacks. At the same time, we use security measures to prevent, where possible, unauthorized access to your personal data and which, with regard to the current state of technology, provide sufficient security. The adopted security measures are regularly updated.
We secure our websites and other systems using technical and organizational measures against loss and destruction of your data, against access by unauthorized persons, their alteration or dissemination. Access to your personal profile is possible only after entering your personal password. In this connection, we would like to warn you that it is necessary that you do not provide your access data to third parties and that after finishing your activity in your personal profile you always log out, especially if you use a computer together with other persons. jollyphonics.sk assumes no responsibility for misuse of used passwords, unless jollyphonics.sk directly caused such situation.
WHAT RIGHTS YOU HAVE IN CONNECTION WITH THE PROTECTION OF YOUR PERSONAL DATA?
Right to withdraw consent. If we process your personal data on the basis of your consent, you have the right to withdraw it at any time on the page relating to your personal data, which is available after you log in here. Withdrawal of consent does not affect the lawfulness of processing your personal data before such withdrawal. Withdrawal of consent also has no effect on the processing of your personal data on the basis of another authorization, especially in connection with processing necessary for performance of a contract or compliance with legal obligations.
Right of access. In accordance with Article 15 GDPR, you have the right to obtain confirmation as to whether and what personal data are processed by jollyphonics.sk and to gain access to such personal data, including information on the purpose of processing, categories of personal data concerned, recipients, planned storage period, existence of the right to request erasure or correction of personal data, the right to lodge a complaint with a supervisory authority, the source of personal data if they were not obtained directly from you, and the fact that automated decision-making takes place, including profiling.
Right to rectification and completion. You have the right to request jollyphonics.sk to correct your personal data if they are inaccurate or to complete them if they are incomplete. You may also correct or complete your personal data yourself through your personal profile on our website if you are registered.
Right to erasure / Right to be forgotten. You have the right for us to erase your personal data if the legal conditions for doing so are met. In particular, in cases where the personal data are not necessary for the above purposes, or you have withdrawn consent, or you have objected to processing and at the same time we are not obliged to continue processing your personal data for compliance with legal obligations or for the establishment, exercise or defence of our legal claims.
Right to restriction of processing. You have the right to restriction of processing of your personal data by Dogged.sk if a) you contest the accuracy of the personal data (for the period necessary to verify their accuracy), b) the processing is unlawful and you request restriction of the use of the personal data instead of their erasure, c) you need your personal data for the establishment, exercise or defence of legal claims, if jollyphonics.sk no longer needs them for the purposes of further processing, or d) you object to processing based on a legal basis for the purposes of our legitimate interests (especially in connection with direct marketing).
Right to data portability. If you request it from jollyphonics.sk, jollyphonics.sk will transfer your personal data directly to another controller, or you have the right to obtain them in a structured, commonly used and machine-readable format.
Right to object. You have the right to object to the processing of personal data based on our legitimate interest pursued by jollyphonics.sk, especially in connection with direct marketing.
Automated individual decision-making. You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. However, such right cannot be exercised if the decision is necessary for entering into or performance of a contract between you and jollyphonics.sk; if it is authorized by law for jollyphonics.sk provided that measures are laid down to protect your rights, freedoms and legitimate interests; or if it is based on your explicit consent.
Right to lodge a complaint. You have the right at any time to lodge a complaint with the Office for Personal Data Protection in connection with the processing of your personal data.
WHEN YOU MAY OBJECT TO PROCESSING AND WHAT IT MEANS:
According to Article 21 GDPR, you have the right to object at any time to the processing of personal data where such processing is based on authorization for the performance of a task carried out in the public interest or is necessary for the purposes of the legitimate interests of jollyphonics.sk. In the case of jollyphonics.sk, you may therefore object to the processing of your personal data for direct marketing purposes. If you no longer wish us to continue sending you our commercial offers or other newsletters in connection with direct marketing, you may object at any time and we will no longer process your personal data for that purpose and no further commercial offers will be sent to you. You may object by sending it to the e-mail address office@jollyphonics.sk or by clicking the link contained in each electronic commercial offer relating to the information that you no longer wish to receive our commercial offers.
